Accused Remanded to Judicial Custody

According to official departmental sources, the prime accused has been identified as Mahesh Chand Gupta, son of Kanhaiya Lal Gupta. Gupta is a resident of Plot No. 204, Bangad Mansion, 2/305, Sector-2, Vidhyadhar Nagar, Jaipur.

Following the collection of undeniable digital and physical evidence, the enforcement team produced Gupta before the Special Court (Economic Offences) in Jaipur on Wednesday. Recognizing the severe damage caused to the state exchequer, the honorable court rejected bail and remanded the accused to judicial custody.

The Modus Operandi: Unrecorded Almond Trade

A meticulous verification of seized business documents, digital records, and a comprehensive audit report revealed a sophisticated shadow operation run by the accused:

• Operation of JSM Industries: Mahesh Chand Gupta was operating a firm under the name JSM Industries.
• The Almond Syndicate: Over three consecutive financial years—FY 2022-23, FY 2023-24, and FY 2024-25—the firm engaged in the large-scale procurement and distribution of premium taxable commodities, primarily almonds.
• Running a Parallel Economy: This massive trading volume was deliberately left completely off the company’s official books of accounts. The syndicate managed the secret supply, unrecorded storage, and clearance of goods without issuing valid tax invoices or paying a single rupee in mandatory GST.

By operating this parallel network, the firm successfully evaded more than ₹50 crore in taxes. The Commercial Taxes Department has extended its investigation to uncover other shell firms, network accomplices, or external entities linked to this tax evasion syndicate.

Arrest Under Section 69 of the GST Act

Given the deliberate concealment of turnover and the scale of the financial fraud, the Enforcement Wing exercised its statutory powers. Mahesh Chand Gupta was arrested under Section 69 of the Central/State Goods and Services Tax Act, 2017, which authorizes immediate arrest in cases where tax evasion exceeds the legally prescribed thresholds for cognizable offences.
