Jaipur, India. In a landmark judgment, Jaipur Metro-I Family Court-4 has granted divorce to a husband, citing mental and physical cruelty by the wife. The court noted that the wife refused physical relations for 15 years, filed false dowry harassment cases, and made baseless allegations of extramarital affairs — all amounting to cruelty.
Court’s Verdict
Judge Pawan Kumar Garg stated that the couple was married on November 3, 2003. There were no physical relations between them from 2003 to 2018. After the husband filed for divorce in 2018, they have lived separately.
Husband’s Plea
Advocate D.S. Shekhawat informed the court that the wife left for her parental home just 20 days after the marriage. Despite repeated attempts to reconcile, her behavior did not improve. In 2004, she left again and never returned, later filing a false dowry case against the husband and his family.
Court Observation
The court observed that the wife abandoned the husband without any reasonable cause. Restoration of marital life was deemed impossible, and the husband was found entitled to a divorce decree.
🧠 Expert View
Legal expert Advocate Deepak Chauhan said that withdrawal from marital obligations, false allegations of immorality, filing fake complaints, threats of self-harm, and public humiliation all constitute mental cruelty and can be valid grounds for divorce under Indian law.
